TERMS AND CONDITIONS OF USE OF THE ZEHIRA ONLINE STORE

1. Subject

These Terms and Conditions govern the rules for using the Zehira online store (the "Site"), as well as the conditions for concluding distance contracts for the sale of the goods offered through it.

By using the Site and/or by placing an order you confirm that you have read these Terms and Conditions and agree to comply with them.

3. Definitions

Seller/Trader – „Zehira Cosmetics“ Ltd., with the details set out in section 2.
Customer/Consumer – any person who uses the Site and/or places an order.
Order – an electronic statement by the Customer to purchase goods through the Site.
Contract – a distance contract between the Seller and the Customer, concluded under these Terms and Conditions.
Goods – the products offered for sale on the Site.

4. Technical platform and account

4.1. The Site runs on the Shopify platform. The payment process ("Checkout") takes place in a secure environment operated by Shopify.

4.2. The Site may be used either with or without creating an account.

4.3. Signing in to an account is done without a password – by means of a one-time verification code sent to the email address provided by the Customer. The Customer is responsible for the accuracy of the details provided and for maintaining access to their email inbox.

5. Prices, currency and availability

5.1. All prices on the Site are quoted in euro (€) and are final, inclusive of VAT.

5.2. The delivery charge is not included in the price of the goods and is calculated and displayed at the checkout step, before the Customer confirms the order. The delivery terms are set out on the "Delivery and payment" page.

5.3. Availability and product characteristics may change. Photographs and visualisations are for information only and there may be discrepancies in appearance due to changes in packaging or design by the manufacturer.

6. Orders and conclusion of the contract

6.1. The Customer places an order by adding the selected goods to the cart and proceeding through the checkout step, where, before final confirmation, they receive information about the total amount due, including the value of the goods and the delivery costs.

6.2. The contract is deemed concluded at the moment the Seller confirms the order by electronic message (order confirmation email) sent to the email address provided by the Customer.

6.3. The Seller is entitled to refuse to fulfil an order for objective reasons (for example lack of availability, a technical error in a stated price or description, or inability to deliver), notifying the Customer and refunding any amounts received where applicable.

7. Payment

The following payment methods are accepted:

Payment by debit or credit card – processed by Shopify Payments in a secure environment. The Seller does not receive or store your payment card details.
Cash on delivery – payment of the amount due to the courier upon receipt of the parcel.

8. Delivery

The terms, timeframes and costs of delivery are set out on the "Delivery and payment" page, which forms an integral part of these Terms and Conditions. Deliveries are made within the territory of the Republic of Bulgaria.

9. Right of withdrawal

9.1. A Customer who is a consumer within the meaning of the Bulgarian Consumer Protection Act has the right to withdraw from the contract without giving a reason within 14 days of the date on which they, or a third party designated by them, received the goods.

9.2. To exercise the right of withdrawal, the Customer must notify the Seller by an unequivocal written statement to info@zehira.com before the 14-day period expires. The Customer may use the standard withdrawal form annexed to the Consumer Protection Act, but is not obliged to do so.

9.3. The Seller will refund the amounts received within 14 days of the date on which it was notified of the withdrawal, and is entitled to withhold the refund until the goods are received.

10. Goods to which the right of withdrawal does not apply

Under the Consumer Protection Act, the Customer has no right of withdrawal, including but not limited to, in the case of:

sealed goods which have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection – which applies to the food supplements offered on the Site;
goods with a short shelf life or goods liable to deteriorate or perish rapidly;
goods which, after delivery, have become inseparably mixed with other goods.

11. Complaints and conformity of the goods

11.1. Independently of the right of withdrawal, the Customer has the statutory rights available in the event of a lack of conformity of the goods with the contract under the Bulgarian Act on the Provision of Digital Content and Digital Services and the Sale of Goods.

11.2. In the event of an evident manufacturing defect, or a wrongly sent or missing product, the Customer must notify the Seller immediately at info@zehira.com.

11.3. Where a complaint is justified, transport costs are borne by the Seller.

12. Important information about food supplements

12.1. The products offered on the Site are food supplements and are not medicinal products. They are not a substitute for a varied and balanced diet and a healthy lifestyle.

12.2. The information on the Site is for information purposes only and does not constitute medical advice, diagnosis or prescription. It should not be used for self-medication or to discontinue prescribed treatment.

12.3. The recommended daily doses must not be exceeded. If you are pregnant or breastfeeding, taking medication or have a medical condition, consult a doctor or pharmacist before use. Keep the products out of the reach of young children.

13. Intellectual property

All content on the Site – texts, photographs, graphics, logo, design, databases and others – is the property of the Seller or is used lawfully, and is protected by applicable law. Copying, reproduction, distribution or commercial use without the Seller's express written consent is prohibited.

14. Limitation of liability

The Seller is not liable for non-performance caused by circumstances beyond its reasonable control (force majeure). The Seller's liability is limited to the value of the particular order, except where the law provides otherwise. This clause does not limit consumers' statutory rights.

15. Personal data

Personal data is processed in accordance with the Privacy Policy and applicable law, including Regulation (EU) 2016/679 (GDPR). Information about the purposes of processing, the legal bases, the recipients of data, the retention periods and the rights of data subjects is set out on the "Privacy policy" page, which forms an integral part of these Terms and Conditions.

16. Changes to the Terms and Conditions

The Seller may update these Terms and Conditions by publishing the new version on the Site. Changes take effect from the date of their publication and apply to orders placed after that moment.

17. Applicable law, disputes and alternative resolution

17.1. All matters not covered here are governed by the applicable Bulgarian law.

17.2. Disputes are resolved by mutual agreement and, failing that, by the competent Bulgarian court.

17.3. The Customer has the right to file a complaint or to seek alternative dispute resolution before:
